DOJ Sues New Jersey City Over Fossil Fuel Ban
On March 31, the U.S. Department of Justice (DOJ) filed a lawsuit against Morris Township, New Jersey, regarding the city’s ordinance that bans gas, oil or propane infrastructure and appliances in most new apartment buildings. The lawsuit claims that this ordinance, enacted in 2022, “threaten[s] American energy dominance and our economic and national security.” It also claims that the ordinance, and similar state- and local-level fossil fuel bans, are void and unenforceable because they are preempted by the Energy Policy and Conservation Act of 1975 (EPCA), which covers the appliances that are banned. This case follows a lawsuit the DOJ filed in January against two California cities that banned natural gas infrastructure in new buildings in 2019 and 2021, respectively.
New York State Delays Implementation of
On April 1, the New York State Department of Environmental Conservation issued a letter to interested parties delaying the enforcement of existing hydrofluorocarbon (HFC) refrigerant regulations for certain owners and operators of regulated equipment who are located in disadvantaged communities or who are small business owners. The Part 494 regulations, effective January 2025, prohibit new products or equipment containing HFCs, which are high Global Warming Potential (GWP) gases that contribute to climate change.
