Presenter's Bio:

Mr. Nudelman concentrates his practice in construction law. For over 25 years he has represented members of the construction industry across a broad spectrum of matters. 

On the transactional side, Mr. Nudelman works with owners and developers, construction managers, general contractors, subcontractors and design professionals to prepare and negotiate contract documents for construction in the New Jersey and New York metropolitan area. Drawing on his experience with construction claims, Mr. Nudelman drafts, modifies and negotiates customized contracts, as well as contracts based on standard industry forms from groups such as the American Institute of Architects, ConsensusDocs and Design Build Institute of America. Mr. Nudelman also works with developers and owners to select the appropriate project delivery system, and then follow through with assistance in contract administration, and, if necessary, claims management.

Mr. Nudelman’s construction contracting work helps his clients manage the risk inherent in construction projects so they may adequately protect their interests now to avoid claims and disputes in the future.

When claims and disputes are unavoidable, Mr. Nudelman draws upon his wide-ranging experience in construction litigation, representing clients in state and federal courts throughout the New Jersey/New York metropolitan area, as well as in local and international mediations and arbitrations. He has defended and asserted claims on behalf of owners, developers, condominium associations, general contractors, design professionals, subcontractors, vendors and sureties involved in public and private construction projects. 

Mr. Nudelman has specific experience with claims and disputes involving change orders and extra work, construction defects, design and performance defects, errors and omissions/professional malpractice, building code violations, project management, delay and disruption, acceleration, liquidated damages, lost productivity, site conditions, warranties, project closeout, construction liens, municipal mechanic’s liens, condominium liens, payment and performance bonds, public contracting and violations under the New Jersey Consumer Fraud Act.

He has also represented clients who receive code violations lodged by state or local enforcement officials under the New Jersey Uniform Construction Code Act, defending them in proceedings in municipal court and before the Construction Board of Appeals and the Office of Administrative Law.

Mr. Nudelman has written numerous articles and spoken at national and local seminars about a variety of construction topics, including the AIA contract documents and the decennial changes, construction claims and defenses, ethics in construction project management and alternative dispute resolution.

ASHRAE New Jersey Chapter President 2024-2025

Happy New Years to everyone and welcome to January, 2025. I hope you all had a great holiday season with friends, family and loved ones. We are now officially in the glacial grips of winter and our heating systems are working hard to keep us all warm. The nights are long and the days are short, though in time, gradually the days will become longer and the air warmer, and in no time at all we will be starting our cooling systems back up. For now, I wish all of you a warm and healthy new year. Let’s make it a good one!

January is the month that we get to have our annual joint meeting with the Mechanical Contractors Association of New Jersey (MCANJ) and the American Society of Plumbing Engineers (ASPE) New Jersey Chapter. It is the largest monthly meeting for ASHRAE and a chance to meet and network with not just other ASHRAE members, but also contractors, plumbing engineers, vendors and other building professionals. This month’s meeting will be Wednesday January 8, 2025 at Galloping Hill Centers located at 1085 Galloping Hill Rd, Union NJ. Cocktail and networking hour begins at 5:00 PM and runs to 6:30 PM, where there will be a bunch of vendors tables and displays so make sure to get there early. Immediately following will be dinner and the technical presentation. This month’s presentation topic will be on Liability and Damages, presented by Steven Nudelman. One of our chapter goals for this year is to increase meeting attendance, so I hope to see as many of you at this month’s meeting as possible for this great topic and to help represent ASHRAE at this joint meeting. If you plan on attending, please make sure to register early at our NJ ASHRAE website as we need to get final head counts, space and dinner coordinated. I would like to thank MCANJ and ASPE for helping to make this annual joint meeting possible and look forward to many more years of collaboration.

I would like to thank all of our committed volunteers, committees, members, construction industry allies and guests. Let’s work together to increasing NJ Chapter membership in 2025 by spreading the word to friends and colleagues who are in our industry, encouraging them to join and to become participating members of our NJ Chapter. New Jersey to provide $150M in municipal aid grants for infrastructure improvements

New Jersey Gov. Phil Murphy said 540 cities and towns across his state would receive $150 million in municipal aid grants to advance road, bridge, safety and quality of life improvements.

The competitive Municipal Aid grants program received nearly 600 applications from 540 different municipalities asking for $375 million in funding. The projects were evaluated and rated on their merits by New Jersey’s Department of Transportation. Every municipality that applied for funding received some funding, he said.

“Municipal Aid allows our communities to undertake transportation projects that significantly improve the quality of life for New Jersey residents,” Murphy said. “Under our Administration’s stewardship, the state is doing its part to help municipalities improve local infrastructure, so we have a safe and efficient transportation system throughout the state.”

More than 41 percent of the funding will go to 176 municipalities with Complete Streets policies. Another $22.2 million is being awarded to 56 communities where the project meets equity criteria to benefit low-income and minority populations.

“Thanks to the Murphy Administration’s ongoing commitment to improving new Jersey’s infrastructure, communities have the resources they need to improve local roads and bridges,” NJDOT Commissioner Fran O’Connor said. “Every one of the 540 municipalities who applied for Municipal Aid received a grant, which will make travel smoother and safer on all of our roads.”

Under the Municipal Aid program, each county is apportioned a share of the total funding based on its population and the number of local centerline miles. NJDOT provides 75 percent of the grant amount when a town awards a contract, and the remaining 25 percent upon completion of the project. Of the $150 million, $10 million is set aside for municipalities qualifying for Urban Aid.

Scholarships

Scholarships are awarded based on the following and for the academic year following the application deadline beginning with the fall semester.  Re-applications will be accepted from former scholarship applicants and recipients provided they meet current scholarship criteria. Students may only receive one Society scholarship in any given year. Scholarship amounts awarded shall not exceed the direct annual cost of attending the educational institution (i.e. tuition, books, supplies, room and board, etc.) through graduation.

1. A cumulative grade point average (GPA) of at least 3.0 on a scale where 4.0 is the highest and/or a class standing of no less than the top 30% evidenced by an official transcript of grades or written statement from a school administrator.
2. Three letters of recommendation, including one from an instructor or faculty advisor, a current or past employer, and another character reference.  In the case of schools with an ASHRAE student branch, a letter from the faculty advisor of that branch may be one of the three letters of recommendation.
